Delhi's Sultanpuri hit-and-drag case: Chargesheet cites 117 witnesses

Three months after a 20-year-woman was killed after being dragged under a car for nearly 14 kilometers in outer Delhi’s Sultanpuri early on January 1, Delhi Police on Saturday filed an 800-page charge sheet in the case, citing 117 witnesses to charged four of the seven accused with murder.

Metropolitan magistrate Sanya Dalal at the Rohini court listed the matter for further proceedings on April 13, saying, “it’s a bulky file and I would need some time to go through the same”.

The accused, who were driving a Baleno, hit the victim, Anjali Kumari, at around 12.50am when she was on her way home on a scooter. The accused drove around for nearly three hours on the stretch between Sultanpuri and Kanjhawala with Anjali stuck on the underside of the car, before her body dislodged in a mangled state and was spotted by a passer-by.

In an official statement on Saturday, deputy commissioner of police (outer) Harendra Singh said, “On the basis of the materials/evidences collected during the investigation, to the best of capabilities, sufficient material has come on record to prosecute accused persons…”

According to the statement, Amit Khanna, Krishan, Mithun and Manoj Mittal have been booked for murder. Ashutosh and Amit Khanna were also booked under provisions of the Motor Vehicles Act.

All the accused were booked for criminal conspiracy, destruction of evidence, harbouring an offender, common intention, and providing false information with intent to cause public servant to use his lawful power to the injury of another person, the police statement said.

The Delhi Police has levelled additional charges against Amit Khanna for rash driving and endangering life or personal safety of others.

Indian Penal Code (IPC) sections 302 (murder), 279 (rash driving) and 337 (causing act endangering life of others) among others were filed against Amit Khanna, who was allegedly driving the car at the time of accident. Khanna was also booked under relevant sections of the Motor Vehicles Act, the police statement said.

Apart from Section 302, Krishan, Mithun, and Manoj Mittal, were booked under sections 201, 212, 182, 34 and 120B of the IPC. The statemend added that Deepak Khanna, Ashutosh and Ankush were booked under sections 201, 212, 182, 34 and 120B of the IPC.

Ashutosh was also booked under section 5/180 (providing vehicle to a person unauthorised to drive) of the MV Act.

Deepak Khanna, Amit Khanna, Krishan, Mithun and Manoj Mittal were arrested on January 2. Two other accused -- Ashutosh Bhardwaj and Ankush -- were earlier given bail by the court. Deepak Khanna’s bail plea was rejected by a sessions court.

The other five accused were produced before the court, which extended their judicial custody till April 13.

The MHA also directed the Delhi Police to suspend the personnel deployed in the police control room (PCR) vans that were patrolling the area for alleged delay in responding to several distress calls made by witnesses.

Multiple CCTV footages from the stretch have also shown presence of PCR vans on the stretch in Sultanpuri at the time, when the five men were driving the Maruti Baleno car with Anjali’s body stuck underneath.

Eleven officials were subsequently suspended.

Anjali was riding the scooter with another friend at the time of the accident. While the friend fell on one side on impact with the Baleno, Anjali fell towards the front and the impact entangled her body to the underside of the car.

Her body was found by local residents in Kanjhawala around 4am.

According to the post-mortem report, Anjali suffered at least 40 grievous wounds. Her skull was fractured and some brain matter was missing, her ribs were exposed from the back, and she suffered deep-cut wounds on both arms and forehead, the autopsy report showed.
