Gurgaon revenue dept told not to register sale deeds of Sec 23 plot

The land in question is a 3.5-acre plot known as Mathur Farm, which is under litigation as per the Haryana urban development authority (Huda) officials. In a complaint to the district administration, nearby residents alleged that the plot is being broken into small plots and sold illegally.

Huda had acquired a few plots in the sector but it was challenged by the owners who got a favourable order from the Punjab and Haryana high court in 2014.

As per the high court order of 2014, the land owners can utilise their plots as per the local laws. This however can happen only if the owners take a licence from the DTCP. However, Huda says the owners have not sought for a licence.

An inquiry initiated under the directions of Gurgaon deputy commissioner TL Satyaprakash had found out on Saturday that fresh sewerage pipes were laid, electricity poles erected, and pillars were demarcated, indicating that the 3.5-acre land was being plotted.

Gurgaon DTP (E) Rajender Sharma, who is investigating the matter, said preliminary investigation found that some people were trying to sell plots without permission. “This land is under litigation as the Huda has filed a special leave petition in the Supreme Court challenging the high court order. The owner does not have a licence or permission from the department and the revenue authorities have been asked to ensure there is no registration of any document,” Sharma said.

As illegal development is happening on one of plots, the department issued notices to 11 owners of plots adjacent to the disputed site regarding the sale of plots to without permission.

The enforcement department has asked buyers to refrain from investing or buying plots in the area as the entire investment could be jeopardized because of the illegality of the project. “No doubt this land belong to the owners but they can’t sell it or develop it without a licence from town planning department. The development can take place only after due permissions are taken,” Sharma said.

Major general (retd) Satbir Singh, who is the complainant in the case, said residents living in the area would not allow an illegal colony to mushroom in the sector. “We will start an agitation if the need arises,” he said.
