Oshiwara police lodge FIRs against Sharma, Irrfan Khan

Illegal alterations such as elevation features, changes in ducts, voids, common passages and construction of part podiums for parking were carried out

The Oshiwara police registered six FIRs, including those against comedian Kapil Sharma and actor Irrfan Khan, on Monday for making alterations to their apartments in their residential tower in Oshiwara, against the BMC plan. Separate FIRs have been registered against four more residents, including the developer MS Dev Land and Housing Pvt Ltd, who owns an apartment. Sharma and Khan are residents of DLH Enclave CTS no. 1A/1B/2 Goregaon village on New Link Road. While Sharma owns a flat on the ninth floor, Irrfan owns a flat on the fifth floor.

“All the accused allegedly made interior changes to their rooms, which is against the Occupation Certificate (OC) plans issued by BMC’s Building proposal department. We will now conduct a detailed investigation of the case and initiate action,” said senior police inspector, Subhash Khanvilkar of the Oshiwara police station. The FIR was lodged by Abhay Dinkar Jagtap, 39, a sub-engineer with BMC P /South ward under section 53(7) of the Maharashtra Regional Town Planning (MRTP) Act.

Three FIRs were registered against Verma who owns a flat on the 16th floor, Gurdeep Narang who owns a flat on the fourth floor and Sara Maini who also owns a flat.

A notice under section 53 (1) of Maharashtra Regional Town Planning Act, 1966 was issued to Sharma, Khan and 14 other flat owners by P south ward office on April 28 for carrying out illegal alterations. The builder misused the refuge area on the sixth floor of the ground-plus-18 floor building as a flat. An internal staircase connecting the 17th and 18th floor was demolished.

Illegal alterations such as elevation features, changes in ducts, voids, common passages and construction of part podiums for parking were carried out. The P/South ward office in Goregaon, which issued the notice, said the police will conduct a panchnama. The BMC may also initiate a demolition. Residents and activists had complained of irregularities in the building in 2014, after which, the BMC had served a notice to DLH. However, the builder sought interim relief from the city civil court in December 2014.

The building was granted an OC in November 2013. The issue came to light after Sharma’s tweets on Friday. His Andheri (West) bungalow has also come under the scanner for illegal extensions.

A second inspection of Sharma’s flat was undertaken in June. A letter dated September 9 by the P/South ward office read, “Mr Kapil Sharma failed to comply with the notice requisitions.” Following this, a complaint was lodged by the ward in the Oshiwara police station under section 53 (7) of the MRTP Act.
