The family court recently granted divorce to a man on grounds of cruelty and desertion, after he proved his wife was part of a prostitution racket.

The man met the woman, who claimed she was a cine artiste, in 2005, and got married soon after. After marriage, the man realised his wife had an erratic schedule. The woman left the man in 2009. Two years after their separation, the man claimed he got a call from the Hyderabad police, stating his wife has been arrested for prostitution. Shocked, the man file for divorce on grounds of adultery, cruelty and desertion.

As the wife failed to appear in the court despite summons, the court held the man had proved his case against the wife on the basis of the statements given by him and the Hyderabad police. The court, however, rejected claims of adultery because the adulterer was not made a co-respondent.

“A reasonable and prudent theory can be applied and it can be held that no husband would tolerate such immoral acts of his wife. It is a social stigma on the petitioner as alleged by him and surely it amounts to mental cruelty,” the court stated.
