Peter denied bail for a second time in Sheena murder case

Judge says releasing him on bail could compromise confidential information contained in case diary

The special CBI court hearing the Sheena Bora murder case on Monday rejected the second bail application of former media baron Peter Mukerjea.

His first bail plea had been turned down in February. Judge H S Mahajan observed that the investigating officer’s case diary contained lot of material against Peter, and that he could not be released on bail at this stage.

The case diary, which reflects the day-to-day progress of the investigation, is a confidential document that only the judge is allowed to read. While rejecting Peter’s bail application, the court said the information contained in it could not be disclosed to the defence yet.

Peter, in his bail plea, had claimed that his wife Indrani had led him to believe that her daughter Sheena was alive and living with a man in the US. His lawyer Abad Ponda told the court that Indrani had managed to convince Peter that Sheena was alive.

Ponda referred to an email sent to Peter from Sheena’s ID a month after her death, which contained praise for Indrani.

The email also stated that Sheena and Indrani weren’t related. Ponda said the mail was sent from Sheena’s account on the instructions of Indrani by Kajal, her secretary.

He argued that the prosecution had not made out a strong case against Peter and that he had been framed. He said Peter was arrested and charged on the basis of little more than suspicion and asked that he be released on bail with strict conditions.

The CBI’s lawyer opposed the bail application, saying Peter had played a key role in Indrani’s conspiracy to kill Sheena. He claimed that Indrani had discussed the plot with Peter during a 686-second conversation the day before Sheena was killed.

On April 24, 2012, Peter Mukerjea’s wife Indrani, her ex-husband Sanjeev Khanna and former driver Shyamwar Rai allegedly strangulated Indrani’s daughter Sheena Bora and later burned and dumped her body in a thicket in Gagode village, Raigad district.

The murder came to light in August last year, when Rai was arrested by the Khar police in an unrelated case under the Arms Act.

Indrani was arrested on August 25 and Peter in November, after the CBI took over the case from the Khar police.
