Noida: FIR filed against 16 builders for not paying stamp duty

After a physical verification of the premises of 24 group housing societies, it was found that properties in 24 projects were found under possession of homebuyers without payment of stamp duty to the government.

The stamps and registration department on Friday filed an FIR against 16 builders for allowing possession of flats in 24 housing projects without paying stamp duty to the government. The FIRs have been filed across police stations in Noida and Greater Noida.

The FIRs were ordered to be registered by the assistant inspector general (AIG), Noida, SK Singh, and AIG, Greater Noida, AK Dubey. The FIRs were filed against builders for handing over newly constructed flats to buyers without obtaining an occupancy certificate and executing registry.

Rakesh Kashyap, district information officer, Gautam Budh Nagar, said, “The two AIGs have ordered filing of FIRs against these builders.”

The projects are Logix Blossom Greens, Sector 143 (40 flats); Sunworld Vanalika, Sector 107 (250 flats); Assotech Salister, Sector 44 (25 flats), Victor Crossroads, Sector 143 (103 flats) Amrapali Platinum, Sector 119 (600 flats); Amrapali Zodiac, Sector 120 (1,600 flats); Amrapali Sapphire, Sector 120 (1880 flats); Divine India, Sector 108 (361 flats), Assotech Infra, Sector 78 (92 flats); AIMS G Angels, Sector 75 (80 flats); PAN Realtors, Sector 70 (400 flats); Amrapali Princely Estate, Sector 76 (700 flats); AGC Ajnara Homes, Sector 121 (50 flats and 39 commercial units); Square ardenia Aims Glory, Sector 46 (800 flats); AVJ Heights, Sector Zeta 1, Greater Noida (920 flats); CCSE Cooperative Housing Society (Vrinda City, Sector Fi-4, Greater Noida (400 flats); Senior Citizen Home Complex Welfare Society, Sector, Kasna (854 flats); Unitech Horizon, Sector Pi-2, Greater Noida (100 flats); Unitech Cascades, Sector Pi-2, Greater Noida (150 flats); Unitech Habitat, Sector Pi-2, Greater Noida (252 flats); Mahalaxmi Green Mansion, Sector Site C, UPSIDC, Greater Noida (325 flats); Tisco Employees Housing and Welfare Society, Sector Beta-2, Greater Noida (28 flats) and Amrapali Leisure Valley, Sector 1, Greater Noida (120 flats).

On Wednesday, district magistrate BN Singh asked deputy registrars 1, 2 and 3 and Sadar to identify all such flats and builders to take legal action against them.

Singh had asked the stamp and registration department to take action under Section 17 of Registration Act, 1908, and Section 13 of the UP Apartment (promotion of construction ownership and maintenance) Act, 2010. Both acts stipulate that a builder cannot allow possession or transfer of ownership rights without executing the registration of the flat.
