Understanding the H-1B Visa: Key Changes Proposed by Trump

The H-1B program applies to employers seeking to hire non-immigrants as workers in specialty occupations or as fashion models of distinguished merit and ability. 

A specialty occupation requires the application of a body of highly specialized knowledge and the attainment of at least a bachelor’s degree or its equivalent. 

The H-1B provisions intend to help employers who cannot otherwise obtain needed business skills and abilities from the U.S. workforce by authorizing the temporary employment of qualified individuals who are not otherwise authorized to work in the United States.

A return to Donald Trump’s restrictive policies regarding the H-1B visa programme will have a substantial impact on Indian professionals in the US.

This will hinder Indian workers' access to the U.S. job market, impacting industries that rely on skilled labour from India, especially in the technology sector.

In addition, tougher immigration laws may encourage Indian tech companies to seek alternative markets or invest in expanding domestic job opportunities.
